These General Terms and Conditions of Sale and Use (the 'Agreement') govern the contractual relationship between:
Any Internet user subscribing to the website https://rust-odyssey.com, operated by NIMBUS2000 SOFTWARE (hereinafter referred to as the “User”),
On the one hand,
And NIMBUS2000 SOFTWARE, a company duly incorporated under applicable laws (hereinafter referred to as 'NIMBUS2000'),
On the other hand.
Individually referred to as a “Party” and collectively as the “Parties.”
NIMBUS2000 provides paid access to an online educational platform dedicated to learning the Rust programming language, accessible at https://rust-odyssey.com (the “Platform”).
The purpose of this Agreement is to define the terms and conditions under which the User may access and use the Platform.
Any User wishing to access the Platform must have read and accepted this Agreement in advance.
During registration, the User is required to expressly accept this Agreement by checking the corresponding box.
If the User refuses to comply with any provision of this Agreement, they must refrain from accessing or using the Platform.
The User declares that they are of legal age or an emancipated minor, or otherwise that they have obtained the authorization of their legal representatives.
NIMBUS2000 reserves the right to modify this Agreement at any time. Any modification shall take effect immediately upon publication on the Platform.
Continued use of the Platform constitutes acceptance of the updated Agreement.
Access to the paid training content requires the creation of a personal account on the Platform.
The User must provide accurate, complete, and up-to-date information when registering.
Registration is finalized upon payment of the indicated price in U.S. dollars (USD), inclusive of all applicable taxes.
All internet and communication costs remain the responsibility of the User.
NIMBUS2000 offers several payment methods, some of which are operated by third-party payment providers.
These providers may apply specific terms and additional fees, which are the sole responsibility of the User.
In accordance with Article L.221-28 of the French Consumer Code, the User acknowledges that the training constitutes digital content supplied immediately upon registration.
The User therefore expressly waives their right of withdrawal.
All elements of the Platform, including texts, videos, graphics, images, audio content, source code, trademarks, logos, and databases, are the exclusive property of NIMBUS2000.
No ownership rights are transferred to the User. A limited right of use is granted for personal learning purposes only.
Any unauthorized use may result in civil and/or criminal liability.
NIMBUS2000 collects and processes personal data in compliance with applicable data protection laws.
The collected data is used for:

The Platform uses session cookies for authentication and audience measurement cookies for anonymous statistics.
Users may disable cookies via their browser settings.
NIMBUS2000 shall only be liable for direct damages resulting from a proven breach of its obligations.
NIMBUS2000 shall not be liable for indirect damages, internet failures, force majeure events, or data loss.
The User may terminate their account at any time via their profile or by contacting support.
NIMBUS2000 may suspend or terminate access in case of breach or with one (1) month’s notice.
This Agreement remains in effect for the duration of the User’s use of the Platform.
This Agreement is governed by French law.
In the absence of an amicable resolution, exclusive jurisdiction is granted to the courts of the Paris Court of Appeal.
